Intellectual Property Right issues

The management of intellectual property (IP) is a fundamental aspect of most EU funded research projects. This is particularly true for projects funded under the Seventh Framework Programme (FP7), where participants have big autonomy in managing their IP and deciding how to use the results of their research.

At the same time, a specifi c legal framework applies to FP7 projects and participants need to be aware of it before making any plans for their project or the use of their results. This legal framework is detailed in the grant agreement that participants sign with the European Commission. Their own decisions and arrangements inside the consortium are implemented through the consortium agreement, signed exclusively by the project participants, whose importance is also fundamental.

In this presentation we will go through the FP7 IP rules and try to fully understand the importance of IP and the legal framework applicable. Moreover, we shall examine the most important IP-related aspects of consortium agreements and make a short comparison of the consortium agreement models available so far.
